To stimulate investment in Guinea, a very liberal Code was promulgated in 1987 by Ordinance No. 001/PRG/87. This Investment Code enshrines the following fundamental principles applicable subject to reciprocity:
- The freedom to undertake, for any person fulfilling the legal conditions, without any discrimination of any kind whatsoever;
- Equal treatment between foreign and Guinean natural and legal persons;
- The freedom to transfer convertible foreign currency assets generated by capital investments from abroad and relating to the income from the operation or liquidation of such investments, or compensation for expropriation or nationalisation in the public interest;
- Equality between the public and private sectors;
- The protection of acquired rights;
- The freedom for any foreigner to carry out economic activities in Guinea without being obliged to associate with a Guinean.
